Need help with realestate agent questions?

February 132010

My mothers landlord has sold the property and was notified today that she has to be out by this Sunday.Does any one have some advice? There is no written.signed notice giving them enough time to move out. The only thing is that she was on a month to month lease due to the fact that the was house put on the market. She has two disabled sons and my sister and her three daughters live with her. It too much of a short notice for them to find something. Can any one help if I provide detail needed.

A month-to-month tenancy requires that they give 30-day notice to vacate, no exceptions. I’m sorry to hear this happen right before Christmas, truly, the landlord has no heart. I’ll say a prayer for your family.

Unfortunately that isn’t illegal. It is rude and very unethical but not illegal. When the lease went to month to month, that was essentially her "notice". She can ask for more time due to her circumstances but the new owner’s may not be too cooperative.

If the lease is month to month basis, its call periodic tenancy and usually atleat 15 – 30 days notice is required.

only few days is not enough notice and you won’t have to go. Let them take you to the court and that will buy you atleat a month to find new place and you can always argue in the court that notice wasn’t enough.

Usually this kind of matters go to the small claim courts and judges over there are more towards situation than sticking to the law.

If the house has been on the market, then your mom knew it was going to happen eventually and she should have been preparing for this and looking for somewhere else all along so you don’t have any legal rights here. But hind sight is 20/20 and all that and now she is in a panic stage so I suggest you call a Realtor immediately!! She can be in a rental by Sunday if she has the deposits. Here in Harris county it can be done in a day with some rental houses.
